After determining the responsible parties, a lawsuit is filed against them naming them as defendants, typically in State District Court. As in all civil cases, the attorneys will then conduct discovery, which is the process by which all relevant evidence is obtained from all parties involved. This can involve written questions, requests for the production of documents, photos, videos, and other tangible evidence, site or product inspections, and sworn depositions of the parties and witnesses.
Attorney Reyes may then retain experts to consult with on particular issues in your case and/or to have them testify on the matter in court. The court may order mediation in an attempt to have the case settle or hear dispositive motions by the parties. If the case does not settle and is not dismissed, it will proceed to trial.
In June of 2019, Samuel Reyes, as lead counsel, obtained a judgment in the amount of $41,076,000.00 in a wrongful death products liability case in Hidalgo County. After the defense filed a Motion for New Trial, the case was subsequently settled for a confidential amount. Samuel currently has an active wrongful death practice serving as lead counsel in numerous wrongful death cases currently in litigation in State District Courts of as of March 2023.

*In the State of Texas, only parents, children, or the spouse of the deceased is eligible to file a wrongful death claim. The deceased’s siblings or grandparents are not eligible to file a wrongful death claim. Also, there is no order or seniority regarding who can file the claim as there are in other states. Any eligible family member may file a wrongful death claim, including family members who want to file jointly.
